A regulated framework with mandatory screening, counselling, independent legal advice, and a licensed oversight body is designed to prevent exploitation. The current law's ambiguity is what pushes some families to less-regulated overseas arrangements where protections are weaker. Regulation replaces ambiguity with accountability.

Do women who act as surrogates come to regret it?

Researchers followed twenty UK surrogates for ten years after the birth. Their psychological wellbeing did not change over that decade, and they scored in the normal range for self-esteem and showed no signs of depression. All of them said the relationship with the intended parents had met or exceeded what they expected, and none reported regret. Are children born through surrogacy harmed by it?

The same research group followed families until the children turned twenty. It found no differences between families formed through assisted reproduction and families who conceived without help, either in psychological wellbeing or in the quality of family relationships. Openness did matter: young adults who had learned about their origins before the age of seven had less negative relationships with their mothers. A separate study found no negative effects on surrogates' own children. The surrogacy sample was small, at 22 families, and not ethnically diverse. Is surrogacy reform a niche issue in the UK?

Surrogacy remains rare, but it is rising. In England and Wales, 537 parental orders were granted in 2025, compared with 477 in 2024. Surrogacy UK has around 2,000 members and has supported the creation of over 500 families.

Could surrogates be forced to hand over a baby under surrogacy reform?

No. Surrogacy agreements are not enforceable as contracts, and reform does not change that: nobody can be made to give up a child because they signed an agreement. The surrogate can withdraw consent from the point of treatment leading to pregnancy until six weeks after birth. If she withdraws before the birth, she is the child's legal parent. If she withdraws after it, the intended parents remain legal parents unless and until the court orders otherwise.
